All artists must be 18 years of age to be eligible to apply.  The chosen artists will be approved by the Public Arts Advisory Committee (PAAC) based on application and submitted images.  The PAAC approves art concepts, project scope and budget, thereby allowing the artist creative license within the established plan.  The PAAC reserves the right to reject any and all applications.  If a proposal is selected, the selected artists will be expected to sign a contract with OCCA.  The Contract will include the artist granting the City of Newport ownership of the artwork after installation.

Artist is an independent contractor.  Artist shall maintain insurance in full force and effect throughout the duration of the mural painting. The insurance shall provide at least the following limits and coverages:

General Liability coverage: Limit:

General Aggregate: $2,000,000

Products Completed Operations Aggregate $1,000,000

Personal and Advertising Injury $1,000,000

Each Occurrence $1,000,000

Fire damage (any one fire) $50,000

Medical Expense (any one person) $5,000

Commercial Auto Insurance:

Artist shall obtain and keep in effect for the duration of the mural execution Commercial Auto Liability coverage including coverage for all owned, hired and non-owned vehicles. The combined single limit per occurrence shall not be less than $1,000,000.

Worker’s Compensation Insurance:

The artist, its subcontractors, if any, and all employers providing work, labor or materials under this agreement are either subject to employers that will comply with ORS 656.017 or employers exempt under ORS 656.126. Out of state employers must provide Oregon workers’ compensation coverage for their workers who work at a single location within Oregon for more than 30 days per calendar year.  Artists who perform work without the assistance of any labor or any employee need not obtain such coverage. This shall include Employer’s Liability Insurance with the coverage limits of not less that $500,000 each accident.

Additional insured: The General Liability insurance and the Commercial Auto Insurances shall include the City of Newport and the Oregon Coast Council for the Arts as additional insured. A certificate of additional insured must be provided before the commencement of the project.
