Care and Preservation:

• The University Art Gallery (UAG) will exercise the same care for the borrowed object(s) as it does in the safe keeping of comparable property of its own.
• Evidence of damage or loss to the Artwork at the time of receipt by Indiana State University (ISU) or while Artwork is in ISU’s custody will be reported immediately to the Lender.
• Unless authorized in writing by the Lender, UAG will not alter, clean, repair or restore the Artwork.

Insurance:

• The Lender will maintain his / her own insurance during the period of the loan, ISU shall be considered a second payer in the event of a loss. ISU accepts no responsibility for any error or deficiency of information to the Lender's insurers or for lapses in coverage.
• Lender will be required to provide ISU with a certificate of insurance before any artwork is on exhibition.
• Property coverage for art exhibits is provided through Affiliated Factory Mutual Insurance Company.
• Coverage exists for:
• Art which is not owned by the campus and is not permanently on campus, such as traveling exhibits.
• Art which is shipped from the campus while in transit to the Lender.
• Coverage will not occur while art is in transit to ISU. The lender will cover all costs to lost or damage artwork while the artwork is in transit to ISU.
• All losses are subject to a $100,000 deductible, payable by the department sponsoring the exhibit.
• A $100,000 deductible applies for art which is stolen without evidence of forced entry or removal of the object (e.g., cut cables, broken locks or pry marks).
• The Lender will need to provide proof of value in the case of a loss.
• Art exhibits which are non-owned and non-permanent are subject to the following valuation criteria: An appraisal is required for any artwork which is valued greater than $10,000. The cost of the appraisal will be covered by the Lender.
• Lenders are expected to furnish proof of previous sales of similar works, or appraisals in order to document the value of a loss.
• Upon receipt of exhibits, each item must be immediately examined for any possible damage that may have occurred during transit. Any damaged packaging must be kept and signs of poor packing must be documented to substantiate loss.
• Art Loss Report Form. In the event of a loss, an Art Loss Report Form must be completed by the department sponsoring the exhibit and submitted with any claim to Risk Management. Additionally, University Police should be contacted to complete an incident report and substantiate forced entry or removal, as appropriate. The claim should include necessary valuation documentation specified in the section above concerning proof of value.

 Reproduction and Credit:

• The Lender grants permission for the objects listed to be photographed, telecast and reproduced for advertising and publicity purposes in both electronic and print media in connection with this exhibition and the University Art Gallery's programs. Any photographs and reproductions of objects shall be limited to publicity and educational use.
• Unless otherwise instructed in writing, UAG will give credit to the Lender as specified on the face of this agreement in any publications or exhibition labels.
• In the case of interactive Artwork, where the artist’s intention for the public to touch manipulate walk on or through, or otherwise physically engage with the Artwork, Lender permits such interaction with Artwork by the public, unless otherwise requested in writing and agreed to by both parties.  Lender agrees not to hold ISU responsible for damage or loss to the Artwork resulting from this interaction, whether or not covered by insurance.

Sales:

• The University Art Gallery does not handle sales. All inquiries with regard to sales will be directed to the Lender or designated agent.

Termination:

• Unless otherwise agreed to in writing, the loan shall terminate two weeks after the last day of the exhibition as stated on the face of this agreement.
• If the Lender does not pick up the objects within two weeks after the loan termination date, the University Art Galleries, following established museum acquisition or deaccession approval procedures, shall have the right to claim the objects as an unrestricted gift or to dispose of the objects in any manner UAG elects.
