Legal Agreement THIS AGREEMENT IS MADE BETWEEN: The (“ARTIST”) listed above and STUDIO CHANNEL ISLANDS. This agreement begins when work is submitted to CAFÉ for consideration. I hereby agree to the following: The artwork(s) exhibited and/or represented by STUDIO CHANNEL ISLANDS pursuant to this Agreement are hereinafter collectively referred to as the “ARTWORK” and refers to those artworks submitted by ARTIST to STUDIO CHANNEL ISLANDS and accepted by THE GALLERY for exhibition. 1. ENTRY FEES (Non-refundable application fees): $55. Acceptance is not guaranteed and the fee is non- refundable. 2. EXHIBITION: Selected ARTWORK will be on display for the duration of the Event/Exhibit at STUDIO CHANNEL ISLANDS’ GALLERY. STUDIO CHANNEL ISLANDS will exhibit artwork selected by Juror in THE GALLERY and online on STUDIO CHANNEL ISLANDS’ webpage (www.studiochannelislands.org) 3. RETAIL: Retail prices for each ARTWORK will be established by the ARTIST. ARTIST is to include gallery commission in the price listed. 4. COMMISSION: The following commission/payment terms will apply to each subject “ARTWORK” sold by THE GALLERY: 60% (payment to ARTIST), 40% (commission to THE GALLERY. 5. ARTIST retains ownership of all “ARTWORK” represented by THE GALLERY until such “ARTWORK” is sold pursuant to the terms of this Agreement or otherwise. ARTIST retains copyright to all consigned artwork in perpetuity, as governed by law. THE GALLERY shall take steps necessary to insure that the Artist's notice of copyright is projected and included in all documentation. 6. ELIGIBILTY: Open to all artists ages 18 and up. All media accepted. 2D ARTWORK must be no larger than 8ft high. All art work submitted shall be original and created by the artist. ARTWORK previously exhibited at THE GALLERY is not permissible. 7. INSTALLATION: All placement and installation of ARTWORK to be done at the discretion of the professional installation team. All work must be delivered within the time frame given by gallery. No late deliveries will be accepted. ARTIST must indicate vertical or horizontal orientation of each piece and include any special installation instructions. Installation team will take requests into consideration All 2D ARTWORK must be delivered ready to hang with appropriate hardware. No saw-tooth hangers. Pedestals will be provided for 3D ARTWORK. 8. DELIVERY: Hand delivered ARTWORK must be delivered to THE GALLERY on date specified above (artwork Drop-off). Shipped work must be received at the gallery on date specified above. ARTIST is responsible for packaging, shipping, delivering, removing, pick-up and insurance of work during transport to and from THE GALLERY. The GALLERY will insure artwork during the exhibition at STUDIO CHANNEL ISLANDS. STUDIO CHANNEL ISLANDS has no responsibility for the damage or loss of the artworks during shipping, delivery, removing, pick-up and returning 9. ADDITIONAL: Please ship work in sturdy, reusable containers via UPS, Fed-Ex or other private carrier. Make sure to include a prepaid return shipping label. Any work left at THE GALLERY for more than 8 weeks after the close of the exhibition is subject to sale or disposal without further notification, unless agreed in writing with the Gallery Director. 10. PROMOTION: All entrants grant STUDIO CHANNEL ISLANDS the right to use or publish images of their work in print, online and on social media sites for promotional purposes. 11.OTHER: In order to offer exhibitions at no cost to artist and public, STUDIO CHANNEL ISLANDS is renting the GALLERY occasionally to third parties (renter). Usage is restricted to events that are suitable for an art gallery. Precautions are taken to keep the art work safe as necessary. The renter is responsible for any and all damages caused by his/her agents, vendors, guests or contractors. 11. HELP and FAQ: Please make sure that your images meet CAFÉ requirements. Please confirm the accuracy of the information of each image. Please confirm that each image has a Title and Description. Please access CAFÉ’s “How to Apply” section on image preparation and other requirements, utilize their help FAQ’s. Technical questions and issues should be emailed directly to CAFÉ tech support. 12. LIABILITY: We recommend that ARTISTS maintain their own insurance. Insurance liability for accidental damage or breakage is not provided by STUDIO CHANNEL ISLANDS. In no event shall STUDIO CHANNEL ISLANDS be liable for any loss, damage, theft or disappearance of or to ARTWORK. All reasonable efforts will be made by THE  GALLERY to protect ARTWORK from accidental damage or breakage.
