RESPONSABILITIES: Against all clams that could arise between the contestant and the competition: Any expenses caused by a foreign money exchange on cash awarded, as well as possible required income tax payment, will be deducted from the prize. These are absolute responsibilities of the artists. Open Art Miami is not responsible for costs, dangers, injuries or other disasters incurred by the contestants during the competition or by acceptance of the finalists and use of the prize. OAM is not responsible for the artist in case of accident, illness or inappropriate behavior. Open Art Miami is not responsible for incomplete application or wrong directed, technical failures, network or involuntary causes. The contestants are the only ones responsible of their registration. The contestant agrees to compensate Open Art Miami completely for author’s rights, fees, and any cash amount due to failure to fulfil above-mentioned. Any photograph used by Open Art Miami should include the author or authors’ credentials. If an omission occurs by mistake, it will not be considered a non-compliance, as long as Open Art Miami makes all efforts to correct it within a reasonable time. Open Art Miami does not assume responsibility for any incorrect, not clear, or incomplete information either caused by the web page users or any equipment or program associated or used in the contest. It is neither responsible for technical failures, hardware or software of any kind; nor connection failures of network, coded computer transmissions or any other technical problems or malfunctions during the contest. Open Art Miami is not responsible for any error, omission, interruption, erases, defect, operation or transmission delays, line failure, theft or destruction, non- authorized access or alteration to the contest deliveries. Open Art Miami is not responsible for any problem or defective technical functioning of the networks or telephone lines, computer online systems, program equipment, failures on any email directed to Open Art Miami due to technical problems, human error, and saturated internet traffic or in any web page. Also any combination of previously mentioned, including injury to the computer owner or any other related person. If by any reason the contestant’s work cannot be visualized or projected as intended due to other causes due to computer virus, errors, manipulation or intervention not authorized, fraud or technical fraud, Open Art Miami declines any responsibilities. Under no circumstances Open Art Miami, its members, temporary partners, workers, directors or employees are responsible for any damage or loss of any kind (direct or indirect), incidental or consequential, special or punitive caused by the contestant and use of the web page due to participation in the contest. Without limiting what has been mentioned before, everything on the Web Page is presented “as is”, without any guarantee, either explicit or implicit. The contestant agrees to participate on the promotion of his name and winning images for Open Art Miami promotion, without additional further compensation. Open Art Miami reserves the right to modify these rules, at its discretion. In the case of winner’s controversy, the Award Committee has the right to grant or not the prizes at its own discretion. The Selection Committee has the right to disqualify any contestant whose application or behavior appears to: Inhibit the enjoyment of others. Manipulate the contest. Violate these rules or other rules or applicable regulations. Infringement of third parties. Act in an unsporting or harmful manner. The decisions made by both the Selection Committee and the Award Committee are definitive and binding. The contestant cannot present materials or introduce any software virus, worms or any other programs designed to damage the software, hardware or telecommunication equipment or be a political supporter, advertising, personal attacks or bad words, or in any way appalling, threatening, illegal, discriminating attitude, obscene, sexual explicit, or infringe the rights of third parties.
