DELIVERY, CONDITION AND CARE. The Artist shall be responsible for arranging to have the artworks listed on the Schedule shipped or delivered to the Lone Tree Arts Center on a date agreed upon by both parties. All costs of delivery (including shipping, transportation and insurance) shall be paid by the Artist. Upon delivery, artwork condition will be reviewed and documented. The City of Lone Tree agrees to use the same standard of care for the work as it uses for comparable works in its own collection. Precautions will be taken to protect the artwork while in the City of Lone Tree’s custody. It is understood by the Artist and the City of Lone Tree that all tangible objects are subject to gradual inherent deterioration for which neither party is responsible. Evidence of damage at the time of receipt or while in the City of Lone Tree’s custody will be reported immediately to the Artist. The Artist shall coordinate and pay for the costs of the return (including shipping, transportation and insurance) of the artwork on the agreed upon date, or else an unrestricted gift of the artwork will be inferred. The artwork will be returned only to the Artist of record unless other arrangements are agreed upon. DAMAGE AND INSURANCE. The Lone Tree Arts Center agrees to extend its property insurance coverage to the artwork exhibited until the designated take down. The Lone Tree Arts Center does not have adequate storage for artworks, if any loss, damage, destruction occurs after that date, the Lone Tree Arts Center or City of Lone Tree will not be responsible, and the Lone Tree Arts Center’s insurance coverage will not apply. USE OF WORK. The City of Lone Tree hereby agrees that the loan of the artworks under this Agreement is solely for purposes of exhibition and that no other uses shall be made of the artwork, such other uses including, but not being limited to commercial exploitation, broadcasts, or other reproduction. INSTALLATION AND REPAIRS. The Artist agrees to provide two-dimensional artwork prepared with a securely fastened wire cable for hanging on the Arakawa Hanging System installed at the Lone Tree Arts Center (D-rings for larger pieces are accepted). Artwork requiring wall mounting with hooks, wooden blocking or sawtooth hangers will not be accepted. In the event framing or mounting requires repairs the Artist will be contacted for immediate repairs. If the Artist is unavailable, the Artist gives the City of Lone Tree approval to repair framing and mounting damage. The City of Lone Tree is responsible for curating and hanging the exhibition. COPYRIGHT AND REPRODUCTION. The Artist reserves all reproduction rights, including the right to claim statutory copyright, on all works listed on the Schedule. The City of Lone Tree may use the works for promotional materials of the exhibition, such as photos for brochures, website use, etc. The Artist must submit two high resolution (300 dpi or higher) photographs of the artwork for this use. All media-related coverage of the exhibition for when the City of Lone Tree or Lone Tree Arts Center’s name are used must be coordinated with the Lone Tree Arts Center Marketing Department prior to the exhibition. COLLECTION OF THE ARTIST. When displayed, each artwork shall be accompanied by a label or plaque identifying the artwork as part of the Commissioners’ Choice Program including the Title of the artwork, the Artist’s Name, the year the artwork was created and the sales price, as provided on the Exhibition Checklist. Artwork labeling will be prepared by LTAC staff. SALES OF ARTWORK. All artwork sales and merchandise will be sold through the Lone Tree Arts Center Box Office and must remain on exhibit through the end of the exhibition. All sales include a sales tax fee of 6.9125% and a RidgeGate Public Improvement Fee (PIF) of 1.25%. Lone Tree Arts Center will collect a 20% sales commission of the purchase price of the artwork before taxes are assessed. The Box Office will be open for artwork sales during standard Box Office hours at Lone Tree Arts Center: Monday through Friday, from 10:00 a.m. to 4:00 p.m.
