*The Entry Fee of $30 is non-refundable 1. The work shall remain in the possession of the George Caleb Bingham Gallery and/or other galleries participating in the exhibition for which it has been borrowed (the “participating galleries”) for the time specified on the obverse, but may be withdrawn from such exhibition at any time by the Director of Trustees of the GCBG and/or of any of the participating galleries. The work will be returned only to the owner or lender at the address stated on the obverse unless the GCBG is notified in writing to the contrary. If the legal ownership of the work shall change during the period of this loan, whether by reason of death, sale, insolvency, gift, or otherwise, the new owner may, prior to its return, be required to establish his/her legal right to receive the work by proof satisfactory to the GCBG. Artwork may be withdrawn or withheld from exhibition at any time due to breach of contract or unacceptable professional methods. Additionally, artwork may be temporarily moved within the gallery in order to allow for events, lectures, meetings, or receptions in the gallery space. 2. Unless otherwise instructed by the lender, the George Caleb Bingham Gallery will insure the work wall-to-wall under its fine arts policy and/or indemnify the work under the U.S. Government Art and Artifacts Indemnity for the amount specified by the lender on the obverse against all risks of physical loss or damage from any external cause while in transit and on location during the period of this loan, provided, however, that if the work shall have been industrially fabricated and can be replaced to the artist’s specifications, the amount of such insurance shall be limited to such amount if any, as may be paid by the insurer, hereby releasing the George Caleb Bingham Gallery and any employees of the University of Missouri from liability for any and all claims arising out of such loss or damage. The insurance deductible will be the responsibility of the artist or lender. 3. If the lender chooses to maintain his/her own insurance, the George Caleb Bingham Gallery must be supplied with a certificate of insurance naming the gallery and each of the participating venues as an additional assured or waiving subrogation against the gallery and each of the participating venues. If the lender shall fail to supply the gallery with such a certificate, this loan agreement shall constitute a release of the gallery and of each of the participating venues from any liability in connection with the work. The gallery cannot accept responsibility for any error or deficiency in information furnished to the lender’s insurer or for any lapses in coverage. 4. In the event that the condition of the work is altered in any way, the George Caleb Bingham Gallery will notify the lender immediately. 5. All items and instructions specified in the rules and guidelines for the George Caleb Bingham Gallery regarding the use of the exhibition space and preparation of event must be followed.
