By applying to the Plein Air on the Santa Cruz (“retreat workshop”) and exhibit, the artist agrees to release the use of any image of themselves and their art in relation to the exhibit applying for, as a permanent record of the exhibition and for promotional use relating to the exhibition and the Art Center. Applicant agrees to all terms listed in the application/prospectus. While Rancho Santa Cruz and Tubac Center of the Arts will make every effort toward your personal safety and the safety of your personal effects, as attendees of Plein Air on the Santa Cruz (“workshop retreat”), you hereby accept all risk to your health and to your injury or death that may result from participating in the workshop retreat and hereby release the Tubac Center of the Arts and Rancho Santa Cruz’s officers, employees, interns, contractors, sponsors and representatives from any and all liability to you, your personal representatives, estate, heirs, next of kin, and assignees for any and all claims and causes of action for loss of or damage to property and for any and all illness or injury to your person, including your death, that may result from or occur during your participation at the retreat workshop. You further agree to indemnify and hold harmless the Tubac Center of the Arts and Rancho Santa Cruz and any third-party company from liability for the injury or death of any person(s) and damage to property that may result from your negligent or intentional act or omission while attending and participating in the workshop retreat. Under no circumstances will the Tubac Center of the Arts or Rancho Santa Cruz or their assignees be held liable for your injury or death or any loss or damage of your personal belongings resulting from your participation in the workshop retreat. Should you require emergency medical treatment as a result of accident or illness arising during your attendance and participation in the workshop retreat, you consent to such treatment. You acknowledge and agree to be financially responsible for any medical or legal bills that may be incurred as a result of emergency medical treatment. You will notify the Rancho Santa Cruz verbally and in writing if you are at any time injured prior to, during, or after the workshop retreat in your travels or attendance, or if you have medical conditions about which emergency medical personnel should be informed; however, you understand that Tubac Center of the Arts and Rancho Santa Cruz are not legally obligated to act on that information in any way or to provide any medical service whatsoever to you. You agree that if you have any medical or psychological conditions that may hamper you from fully and healthfully participating in the workshop retreat that you will notify Rancho Santa Cruz in writing and that the Rancho Santa Cruz and Tubac Center of the Arts retain the right to ask that you not participate in portions of or the entirety of the workshop retreat.
