A.I.R. Studio Paducah 2018 TERMS AND CONDITIONS A.I.R. Studio Paducah reserves the right in their sole discretion to reject any or all applications or applicants, and to modify or terminate the application process or the selection process for any reason and without prior notice. The applicant certifies that the information contained in the application, including all supporting documents and attachments, is true and correct to the best of his or her knowledge. Any fraudulent statement made in the application will be grounds for denying a commission agreement. LIMITS OF LIABILITY A.I.R. Studio Paducah is not responsible for damage or loss of materials submitted to its office, whether or not such damage or loss is caused by A.I.R. Studio Paducah negligence, its employees or agents. All supporting documents must be submitted as digital files. No original or single editions of works will be accepted. This Call for Entries does not commit A.I.R. Studio Paducah to enter into an agreement, to pay any costs incurred in the preparation, travel to, or execution of the residency and completion of residency requirements. RESPECTIVE PROPERTY OF THE PARTIES & DOCUMENTATION All rights, creative work and efforts of the Resident shall be and remain the property of the Resident. A.I.R. may ask Resident for permission to document the residency. The documentation will be used to promote the residency program only unless otherwise agreed upon. PUBLIC EVENT SUPPORT Residents may hold a public event: exhibition/workshop/ presentation, while in residence. A.I.R. Studio Paducah will assist in promoting the event provided we are notified in advance. Please indicate that you are a “Resident Artist at A.I.R. Studio Paducah” in any press materials sent out. HOLD HARMLESS The resident agrees that neither A.I.R. Studio Paducah nor any of its officers, directors, and employees will be liable for any damages arising from personal injuries sustained by the resident or their guests in or about A.I.R. Studio Paducah premises as a result of using the facilities and any equipment, services, food or other provisions. The resident agrees that neither A.I.R. Studio Paducah nor any of its officers, directors and employees shall be liable for any loss or theft of personal property. INDEPENDENT GUEST During the visit to the Paducah, Kentucky area, the resident is an independent guest. The resident agrees to be responsible for his or her own actions as they pertain to the local community and state and federal laws and regulations. MEDICAL AWARENESS The resident is responsible for informing A.I.R. Studio Paducah of any serious or life- threatening medical conditions and any medications taken regularly. Should the resident have any specific medical requirements, any special arrangements must be noted in the application in advance of the residency. CODE OF CONDUCT During the residency, the resident agrees to respect the A.I.R. Studio Paducah facilities. The resident is expected to conduct him/herself in an appropriate manner. A.I.R. Studio Paducah reserves the right to end an A.I.R. Studio Paducah's (and any of their guests) at their discretion. DRUGS/FIREARMS A.I.R. Studio Paducah prohibits the use or possession of drugs prohibited by law. A.I.R. Studio Paducah prohibits the possession of firearms or other weapons. GUESTS During your residency, you may have spouse/partners/collaborators/ guests stay with you in your live/work space. Guests are subject to the same conditions contained in this contract. EQUAL OPPORTUNITY: It is the policy of A.I.R. Studio Paducah that there shall be no discrimination with respect to selection of residents because of race, color, religion, national origin, gender, age, sexual orientation, physical limitations or military status. FACILITIES Residents will be provided a fully furnished apartment, workspace and free wireless internet service during the residency. Utilities included. The residence must be left in the same condition as it was upon arrival. FACILITY SECURITY The Resident will be provided with a key to the premises. The key is not to be duplicated. An additional key can be supplied if necessary. All doors are to be locked when you leave the premises. A bicycle is provided for local transportation along with a bicycle lock. When not in use the bicycle is to remain inside the building. Occasional access to the premises by representatives of A.I.R. Studio Paducah for maintenance or repairs is sometimes required and will be announced except in extreme cases. The Resident agrees to notify A.I.R. Studio Paducah promptly of needed repairs and such repairs will be made within a reasonable time. COST The residency fee is $550 per two week period and $875 per month. A Fifty percent (50%) deposit is due ninety (90) days prior to arrival. The balance is due thirty (30) days by or before your arrival. Travel, meals, supplies, shipping expenses, travel and local transportation expenses are the responsibility of the Resident. CANCELLATION Cancellation within sixty (60) days prior to arrival will result in loss of deposit. SECURITY DEPOSIT A $100 refundable security deposit (via check or PayPal) must accompany payment of the balance of the residency fee . This deposit will be held in escrow until the end of the residency and returned in full if there are no damages or in part if there are some damages to any A.I.R. Studio Paducah property. PayPal deposits can be made to account: 202-438-5710. Resident shall make restitution for intentional or unintentional damage to any A.I.R. Studio Paducah property (including but not limited to) tools, equipment, and residence) caused by resident. INTERVIEW At the conclusion of your residency, A.I.R. Studio Paducah may ask you to participate in an evaluation interview of the residency program. If agreed upon Resident agrees to allow documentation of the interview for A.I.R. Studio Paducah’s promotional materials. AGREEMENT ACCEPTANCE: By applying to A.I.R.Studio Paducah through CAFE, the resident agrees to all conditions detailed in this agreement.
