Ventura College New Media Gallery Submission to this juried exhibition constitutes an agreement on the part of the entrant to the conditions set forth in this prospectus. Ventura College reserves the right to final curatorial, educational, installation and marketing decisions. Terms & Conditions: If accepted, I agree to loan Ventura College the artwork associated with my submission at no cost to the College. I understand that the artwork will be on public display at Ventura College’s New Media Gallery from March 7, 2019 – April 12, 2019. Ventura College shall retain a 25% commission from the sale of artwork in the exhibition, including sales that occur as a direct result of the exhibition for up to 6 months following the close of the exhibition (April 30, 2019). I certify that the loaned property is in such condition as to withstand ordinary strains of packing and transportation and handling. I am responsible for delivering the artwork to the New Media Gallery no later than February 21, 2019. I am responsible for removing the artwork from New Media Gallery or include all packing material and labels to have the item or items returned at no cost to the college no later than May 3, 2019. Customs regulations will be adhered to in international shipments and I am responsible for adhering to my country’s import/export requirements. I understand that Ventura College will unload and unpack the artwork and it will be handled by Ventura College personnel. I further understand and agree that Ventura College will not clean, restore, reframe or otherwise alter the loaned property unless agreed upon in writing by me. I will provide Ventura College written packing instructions, cases, and a case list. I understand that Ventura College will photograph the artwork upon receipt and prior to shipment for assessment purposes. Upon receipt of artwork, I shall keep any damaged packaging and document any signs of poor packing. I shall also keep a written record of the condition of the artwork. I understand that Ventura College will give prompt notice to me in writing in the case of damage and/or loss to the loaned property at the time of receipt or while in the custody of Ventura College. I understand that Ventura College shall not make any alterations or repairs to the loaned property without prior written approval from me unless the artwork has become a health or safety hazard. Ventura College shall repack and reload the artwork at the conclusion of the event. Ventura College shall be permitted to photograph, film and videotape the artwork for reproduction in its publications, for advertising, and for publicity purposes connected with the Exhibition. Slides may be made and retained on a permanent basis by Ventura College for educational and instructional purposes, and the object, photographs, or slides may be used for non-commercial television and/or video programs prepared by Ventura College. It is understood that the Exhibition may be photographed by the general public. I agree to and shall defend, save, hold and keep harmless and indemnify Ventura College and its employees, agents, officers, directors and students from and for any and all claims and liability for losses of or damage to property or injuries to persons including claims, demands, judgments, costs, damages, reasonable attorney’s fees, and expenses of any nature whatsoever occasioned wholly or in part by or resulting from any acts or omissions by me or my agent(s), arising out of the activities connected with the Exhibition, except to the extent that such loss or damage was caused by the negligence or willful misconduct of Ventura College, its employees or agents. If the Exhibition cannot take place, in whole or in part, because of an Act of God, National Emergency, war, labor dispute, fire, casualty or other unforeseen occurrence or any other cause beyond the control of Ventura College or which Ventura College is unable to avoid by exercise of due diligence, Ventura College shall have no obligation or liability whatsoever to me as a result thereof.
