In the exhibit’s first seven years, we have proudly displayed over 280 local pieces of art for the Arena’s estimated 1.5 million annual visitors…this exhibition has not only brought tremendous awareness to the talent of our local emerging artists but it has also directly benefitted the artists as all art is for sale, with proceeds directly going to the artist. Each year, we have received hundreds of submissions from which to choose from, and we are excited that we will again be joined by representatives from the Tampa Museum of Art, Museum of Fine Arts, the Ringling Museum of Art and the Dali Museum to help us select the winning pieces.
We're excited to display art that visually celebrates Tampa Bay and its people so that our building can exude the vibrancy and energy of the community. Please feel free to be creative and depict anything and everything that inspires you locally….and if you are able to weave in the love of hockey, even better! We welcome artists of all ages, and have a special category for artists under 18 years of age.
The unveiling and reception will be held in late September to early October 2019.

LIGHTNING FOUNDATION ‘OPEN ARTIST CALL’ CONTEST
OFFICIAL RULES (the “Official Rules”)
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID OUTSIDE OF FLORIDA AND WHERE PROHIBITED BY LAW. Lightning Foundation, Inc., the official charity of the Tampa Bay Lightning (the “Lightning”) and a Section 501(c)(3) tax-exempt organization (“Foundation” or “Sponsor”), is sponsoring an “Open Artist Call” contest (the “Contest”) wherein certain pieces of art will be showcased around AMALIE Arena (the “Arena”) 401 Channelside Drive, Tampa, FL 33602 for a designated period of time.
1. Eligibility: The Contest is open to legal U.S. residents who (i) are at least 18 years old, or at least thirteen (13) years of age with parent/guardian consent and agreement to these Official Rules at time of Contest entry, and (ii) are legal residents of, and living within, the state of Florida at the time of Contest entry. Any parent/guardian agreeing on behalf of a child over 13 agrees that the child’s entry into the Contest must be supervised by the parent/guardian, who is fully responsible for such entry. Children under 13 may not enter the Contest and their parents/guardians cannot agree to these Official Rules on their behalf. Employees, officers, directors, agents, representatives and volunteers of the Foundation, the Lightning, Western States Arts Federation Corporation (“Western States”), Call for Entry (“CaFE”), any other entity directly involved in the development or administration of the Contest, and the members of their immediate family (defined as spouses, parents, siblings, and children) and households, are not eligible to enter or win. The term “household” includes all persons residing together (part-time or full-time) in a single residence, whether or not related.
2. The Contest is subject to all federal, state and local laws. Sponsor shall be entitled to interpret these Official Rules as needed — including but not limited to rules regarding deadlines, winner selection, prize restrictions, and eligibility — and all such decisions are final. By participating, you irrevocably, fully and unconditionally agree to be bound by these Official Rules and waive any right to claim ambiguity in these Official Rules and/or in any other Contest and/or Contest-related advertising or materials.
3. Contest Timeframe: The Contest begins at 9:00 a.m. Eastern Time (“ET”) on Friday, February 2, 2019 and ends at 11:59 p.m. ET on Friday, September 6, 2019 (the “Contest Timeframe”). All submissions must be received within the Contest Timeframe in order to be considered eligible for any of the Prizes (defined below). Any individual that submits a piece of artwork to Sponsor in connection with this Contest is referred to herein as a “Contestant”, or collectively, as “Contestants”.
4. How to Enter: During the Contest Timeframe Contestants may go to www.callforentry.org or www.tampabaylightning.com/art (wherein Contestants will be directed to www.callforentry.org) to access the online entry form for the Contest to submit a Qualifying Submission (defined below). Contestants who submit all non-optional data requested on the online entry form (which may include their complete name, date of birth, address, city, state, zip code, telephone number, and/ or e-mail address) via the online entry form will be automatically entered in the Contest. Entries that do not contain all of the non-optional data are void and will be rejected without any notice to Contestant.
NOTE: If accessing the website via a mobile device, message and data rates may apply. Not all mobile telephone providers carry the service necessary to participate in this Contest. Entrants should consult their wireless provider’s pricing plans.
5. Qualifying Submission: With the exception of computer-generated artwork (defined for purposes of this Contest as any image generated with the assistance of a computer/tablet or computer program), all mediums of artwork, including, without limitation, original (i) paintings, (ii) photographs, (iii) drawings, and (iv) sculptures are acceptable (the “Qualifying Mediums”). The Qualifying Mediums are subject to the following size restrictions: (a) hanging artwork cannot exceed six feet (6’) by six feet (6’), including any frame attached thereto and (b) sculptures cannot exceed seven feet (7’) in height by six feet (6’) in length (the “Size Limitations”). Each Contestant may enter up to three (3) submissions (the “Maximum Number of Entries”). Provided that the submission is a Qualifying Medium that does not exceed the Size Limitations, the submission tendered shall be deemed a “Qualifying Submission”. In the event that an individual Contestant submits the Maximum Number of Entries, any submission/entry that follows the initial three (3) entries will not be considered for a Prize (the “Rejected Submission”). Contestant shall have the option, however, to withdraw a prior Qualifying Submission in lieu of the Rejected Submission, provided that such substitution is communicated in writing to Sponsor a minimum of twenty-four (24) hours before the Contest Timeline deadline (the “Substituted Submission”). Sponsor shall not have any liability, to Contestant or otherwise, in the event that the Substituted Submission is not timely entered into the Contest and/or adjudicated by the Panel (defined below).
6. Prizes:
a. Forty-one (41) Qualifying Submissions (together, the “Winners”, or individually, a “Winner,”) will be selected by Sponsor as follows: twenty-eight (28) non-cash-winning Winners and thirteen (13) cash-winning Winners.
b. Regarding the cash-winning Winners, the thirteen (13) prizes will be determined based on the following categories (together, the “Prizes”):
i. Three (3) Winners in the General Category (the “General Winners”);
ii. Seven (7) Runners-Up in the General Category (the “Runner-Up Winners”); and
iii. Three (3) Winners in the Youth Category (the “Youth Winners”). All entrants in the Youth Category must be between the ages of 13 and 18 years old.
c. The Prizes shall be distributed as follows:
i. General Winners will each receive One Thousand Dollars ($1,000);
ii. Runner-Up Winners will each receive Two Hundred and Fifty Dollars ($250); and
iii. Youth Winners will each receive Two Hundred and Fifty Dollars ($250).
d. Each Winner shall be solely responsible (at its sole cost and expense) for (a) any taxes due on their Prize, (b) any costs associated with creating/producing the Qualifying Submission, and (c) any costs associated with submitting the Qualifying Submission to Sponsor. The total Approximate Retail Value (“ARV”) of all available Prizes is $5,500.
7. Selection of Winner:
a. Panel: Sponsor shall designate a panel of judges (the “Panel”) to adjudicate the Contest and the Qualifying Submissions. The precise number of judges on the Panel shall be determined at the sole discretion of Sponsor. Subject to change by Sponsor, the Panel shall consist of local art leaders, various community figures, and/or Lightning Foundation personnel.
b. Criteria: The Contest Winners will be selected by the Panel from the Qualified Submissions based on a one hundred (100) point system wherein two (2) criteria are evaluated: (1) visual impact and (2) conceptual impact (the selected artwork is referred to collectively herein as the “Selected Submissions”, or individually, a “Selected Submission”). Contestant hereby acknowledges that (i) the precise weight/point allocation given to each of the aforementioned criteria is solely in the discretion of the Panel, (ii) all Contest decisions shall be final, and (iii) Contestants will have no right, pursuant to these Official Rules or otherwise, to challenge the decisions of the Panel and/or the Prize decisions.
c. On or about September 23, 2019 Sponsor (or its designated agent) will notify the Winners via telephone call and/or at the number/email address provided at the time of entry (the “Prize Notification”). If a Winner does not respond to Sponsor within thirty-six (36) hours of the Prize Notification, or declines the Prize for any reason, the Prize will be forfeited, and at Sponsor’s sole discretion and time permitting, Sponsor may either (i) select an alternate winner (i.e., the next Qualified Submission with the highest points), or (ii) void the Prize. In the event that Sponsor elects to select an alternate winner pursuant to the terms of this Section, Sponsor will not have any further obligation to the original winner and the original winner will have no further claim against Sponsor.
d. Noncompliance with these Official Rules or the return of the Prize (or any portion thereof) or Prize Notification as undeliverable may result in disqualification and Prize forfeiture and, at Sponsor’s sole discretion and time permitting, may cause an alternate potential winner (i.e., the next Qualified Submission with the highest points) to be selected. Contestants acknowledge that (i) it is their responsibility to check their phone, text message and/or email inbox and to ensure they receive any phone call and/or email from Sponsor in connection with this Contest, and (ii) Sponsor will not be held responsible for any failure by the Winner to timely claim the Prize in connection with the Winner’s failure to receive any message transmitted by Sponsor.
e. Acceptance of (i) a Prize and/or (ii) designation as a Selected Submission constitutes express permission for Sponsor and its agents/designees to showcase the Selected Submission in and around AMALIE Arena (the “Showcase”).
8. Prize Conditions:
a. All Prize details will be determined in the sole and absolute discretion of Sponsor. Winner is fully responsible for any and all applicable federal, state, territory, and local taxes (including income and withholding taxes). Any person who wins prizes through any Foundation-sponsored promotions with cumulative value equal to or greater than $600 in a calendar year will receive an IRS MISC 1099 form or other required tax form. All costs and expenses associated with the Prize acceptance and use not specified herein as being provided, including but not limited to transportation costs, shipping costs, meals, gratuities and other expenses incurred by accepting the Prize are the sole responsibility of the Winner. The Prize is non-transferable and non-assignable, with no cash redemptions except at Sponsor’s sole and absolute discretion. Sponsor reserves the right to substitute the Prize (or any portion thereof) with a prize of comparable or greater value at its sole and absolute discretion. Any such changes will be announced.
9. Verification Paperwork: Sponsor may require the potential Winner to provide his/her mailing address, telephone number, and other contact information, an executed (and if required, notarized) Affidavit or Declaration of Eligibility and Liability/Publicity Release, and a completed W-9 tax form (collectively, the “Verification Paperwork”) in order to receive the Prize.
10. The Showcase; Sponsor’s Display Rights:
a. Winner acknowledges that Sponsor shall have the right to display or otherwise showcase the Selected Submissions in and around AMALIE Arena through and including September 23, 2020 (the “Showcase Period”). Winner hereby acknowledges that Sponsor (i) shall have full discretion in selecting the precise Showcase location, if any, (ii) may, at any time and as many times as may be desired, re-locate the Selected Submission during the Showcase Period, and (iii) may elect, for any reason whatsoever, not to display any or all of the Selected Submissions.
b. On the earlier of (i) ten (10) calendar days after the expiration of the Showcase Period or (ii) ten (10) calendar days after receipt of written notification (email accepted) from Sponsor, each Winner shall, at its sole cost and expense, pick-up its Selected Submission from AMALIE Arena (the “Pick-Up Timeframe”). Following the timely delivery of written notification to Sponsor, Winners shall have the option of designating an agent to pick-up the Selected Submission on their behalf during the Pick-Up Timeframe. In the event that Contestant (or its designated agent, if applicable) does not timely adhere to the Pick-Up Timeframe, Sponsor shall have the right, at its discretion, to store, dispose, donate, give away, or otherwise discard the Selected Submission, without liability or further obligation to Contestant or any of Contestant’s designated agents, assigns, or heirs. TRANSPORTATION TO/FROM THE ARENA TO PICK UP SELECTED SUBMISSION NOT INCLUDED.
c. In connection with the Sponsor’s Showcase rights, Winner hereby grants Sponsor and its Related Entities (defined below), agents, and/or designees a non-revocable, non-exclusive license to copy, publish, perform, or otherwise feature, in any medium, whether now known or hereinafter developed (including, without limitation, in television, print, or on the Internet), the Selected Submissions in any of their respective advertising, marketing, and/or promotional initiatives (the “Promotional Use Rights”). Regarding the Promotional Use Rights, Sponsor and Winner hereby agree that: (i) the rights shall encompass, without limitation, any AMALIE Arena, Tampa Bay Lightning, The Identity Tampa Bay, Tampa Bay Entertainment Properties, and any of their affiliates’ (collectively, the “Related Entities”) media platforms or campaigns, (ii) any exercise by Sponsor or its Related Entities of its Promotional Use Rights shall not entitle Winner to any compensation, and (iii) Sponsor shall not have the right to sell, license, or otherwise grant any intellectual property rights associated with the Selected Submission to any third party (other than Sponsor and/or its Related Entities’ telecast partner), without the prior written consent of Winner.
d. Winner shall have no right to the return of the Selected Submission until the expiration of the Showcase Period.
e. Winners hereby acknowledge that while Sponsor will use commercially reasonable efforts to ensure that the Selected Submissions are not damaged while in Sponsor’s possession, none of the Released Parties (defined below) shall have any liability, to Winner or to any third party (including any agent, assign, or heir of Contestant), for any damage to or destruction of any Selected Submission.
11. PRIVACY POLICY: Any personally identifiable information collected during an entrant's participation in the Contest will be collected by Sponsor, CaFE, and/or their designee and used by Sponsor, CaFE, their affiliates, designees, agents and marketers for purposes of the proper administration and fulfillment of the Contest as described in these Official Rules and otherwise in accordance with Sponsor’s privacy policy at https://www.nhl.com/lightning/team/privacy-policy, and CaFE’s communication policy at https://www.callforentry.org/cafe-communication-policy/.
12. Promotional Usage of Likeness: By participating, each entrant agrees to award Sponsor and the Related Entities the right to publicize his or her name, photographs (including the use and appearance of his or her photograph on Sponsor’s website/social media pages or channels), likeness, biographical information, e-mail address, voice and details of winning for advertising, promotional and/or trade and/or any other purpose in any and all media or format now known or hereafter devised throughout the world, in perpetuity, without limitation and without further compensation, consideration, permission or notification, except where prohibited.
13. Sponsor may, in its sole discretion, post the verified winner’s name on the Sponsor’s website, including https://www.nhl.com/lightning/community/lightning-foundation, and on or in any of the Sponsor’s social media pages or channels.
14. Entrant Warranties and Representations: By entering into the Contest, each entrant agrees to be bound by these Official Rules, and any revised version hereof, and warrants and represents (i) that they are eligible to enter the Contest in accordance with any and all applicable law and these Official Rules, and (ii) that the Qualified Submission is an original work of authorship and he/she owns all right, title and interest in and to the Qualifying Submission and that the submission, publication, and/or reproduction of the Qualifying Submission in connection with the Contest will not, in any way, infringe upon the rights of any third party or will not otherwise violate the Lanham Act or 17 U.S.C. Entrant consents to Sponsor’s (or the Related Entities’) use of Entrant’s personal information, as described herein.
LIMITATION OF LIABILITY & DISCLAIMER OF WARRANTIES.
15. The term “Released Parties” shall mean (a) Lightning Foundation, Inc.; (b) Tampa Bay Arena, L.P.; (c) Lightning Hockey LP; (d) Western States Arts Federation Corporation; (e) CaFE; (f) the NHL, NHL Enterprises, L.P., NHL Enterprises Canada, L.P., NHL Enterprises B.V., NHL Interactive CyberEnterprises, LLC, National Hockey League Foundation, NHL Foundation, each of the other thirty (30) member clubs of the NHL, and each of their respective subsidiaries or affiliated entities, including any entity which, now or in the future, controls, is controlled by, or is under common control with the NHL or any of its member clubs, and the directors, officers, employees, partners, shareholders, owners and agents of the above entities (collective, the “NHL Entities”); (g) any other company involved in the development or administration of the Contest; and (h) their respective parent companies, subsidiaries, agencies, affiliates, franchisees, promoters, prize suppliers, directors, officers, employees, agents and related persons.
16. By participating in the Contest, you agree that the Released Parties: (a) are not responsible for technical failures of any kind, including but not limited to lost, disconnected, interrupted, or unavailable network, server, or other connections, late, lost, undeliverable, damaged or stolen mail, or for any failed telephone or computer hardware or software, or for any failed, delayed, misdirected, corrupted, or garbled transmissions or errors of any kind, whether human, mechanical, or electronic; (b) are not responsible for any incorrect or inaccurate information, whether caused by participant or other participant’s, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in the Contest, the printing of this offer, the administration of the Contest, the selection or announcement of the Winner or Prize; (c) are not responsible for any injury or damage to any computer, modem or other electrical device as a result of participation in the Contest or downloading of any software or materials; (d) are not responsible for unauthorized human intervention in any part of the Contest; (e) are not responsible for any unauthorized third-party use of any entry materials; (f) are not responsible for the inability to select the Winner because of postal failure, equipment failure, or data storage failure; and (g) are not responsible for any printing, typographical, technical, computer, network or human error that may occur in the administration of the Contest, selection of Winner, verification of the Winner, the Prize or otherwise in any other Contest and/or Contest-related materials.
17. RELEASED PARTIES EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND (WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE), INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. RELEASED PARTIES SHALL NOT BE LIABLE OR RESPONSIBLE FOR THOSE GUARANTEES OR WARRANTIES MADE OR OFFERED BY ADVERTISERS, PARTNERS, MANUFACTURERS OR SUPPLIERS, INCLUDING THOSE RELATED TO PRIZE. UNDER NO CIRCUMSTANCES SHALL RELEASED PARTIES BE HELD RESPONSIBLE OR LIABLE FOR YOUR USE OF THE INFORMATION AND/OR PRODUCTS PROVIDED AND/OR MADE AVAILABLE THROUGH THE CONTEST OR FOR ERRORS OR ANOMALIES RESULTING IN THE UNINTENDED OR ERRONEOUS PARTICIPATION, AWARD OF THE PRIZE OR OTHER BENEFITS UNDER THESE OFFICIAL RULES. RELEASED PARTIES OFFER NO ASSURANCES, GUARANTEES OR WARRANTIES THAT THE CONTEST PAGE OR RELATED WEBSITES WILL BE UNINTERRUPTED OR ERROR-FREE AND DO NOT GUARANTEE THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE CONTEST.
18. By participating in the Contest, you agree to release, defend, indemnify and hold Released Parties harmless from all alleged, existing, or future actions, claims, and/or liabilities of whatever nature including, but not limited to, personal injury, bodily injury (including, without limitation, wrongful death and disability), property damage, and expense (including, without limitation, reasonable attorneys’ fees) and loss or damage of any other kind, relating to or arising from, in whole or in part, directly or indirectly, (a) your participation, or inability to participate, in the Contest, or any Contest-related or Prize-related activity; (b) the use by Released Parties (including modification, adaptation, and reproduction) of entry materials during or after the Contest; (c) the delivery, acceptance, possession, redemption, use, misuse, loss, or misdirection of the Prize; and (d) any other claim or cause of action you may have against any Released Party.
19. BY PARTICIPATING IN THE CONTEST, YOU FURTHER AGREE THAT (A) ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE CONTEST OR THE PRIZE, SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THE CONTEST, BUT IN NO EVENT ATTORNEYS' FEES; AND (C) UNDER NO CIRCUMSTANCES WILL YOU BE PERMITTED TO OBTAIN ANY AWARD FOR, AND YOU HEREBY WAIVE ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED, AND ANY OTHER DAMAGES OTHER THAN ACTUAL OUT-OF-POCKET EXPENSES. WITHOUT LIMITING THE FOREGOING, BY PARTICIPATING IN THE CONTEST AND/OR ACCEPTING THE PRIZE, YOU RELEASE, FOREVER DISCHARGE, COVENANT NOT TO SUE AND HOLD HARMLESS RELEASED PARTIES FROM ALL CLAIMS, DEMANDS, DAMAGES, LOSSES AND LIABILITIES OF ANY NATURE WHATSOEVER, WHICH YOU MAY NOW OR HEREAFTER ASSERT.
20. SOME STATES DO NOT ALLOW LIMITATIONS ON THE ABILITY TO PURSUE CLASS ACTION REMEDIES, OR ON CERTAIN KINDS OF DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU IN WHOLE OR IN PART.
MISCELLANEOUS
21. Sponsor reserves the right to cancel, suspend or terminate the Contest, or other part thereof, if Sponsor determines, in its sole discretion, that the security, administration, fairness and/or operation of the Contest has been corrupted or impaired by any non-authorized intervention, network failure, information storage failure, telecommunications failure, malfunction, or any other cause beyond Sponsor’s control. In such an event, the Sponsor will post notice at its website and select the Winner all non-suspect entries received prior to the suspension, cancellation or termination of the Contest or in such other manner as Sponsor, in its sole discretion, deems fair and appropriate under the circumstances.
22. Sponsor reserves the right to disqualify any individual from further participation in the Contest if Sponsor concludes, in its sole discretion, that such person (a) has attempted to tamper with any entries or the operation of the Contest, (b) has repeatedly disregarded or has attempted to circumvent these Official Rules, or (c) has acted towards Sponsor or any other participant or person in an unfair, inequitable, deliberately annoying, threatening, disrupting or harassing manner. Tampering includes attempting to submit entries except as permitted herein, including by using any prohibited device or method. Any failure by Sponsor to enforce any of these Official Rules shall not constitute a waiver of such Official Rules.
23. ANY ATTEMPT BY ANY INDIVIDUAL TO DEFRAUD, TAMPER WITH, OR DELIBERATELY UNDERMINE, THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO PURSUE ANY AVAILABLE DAMAGES OR REMEDIES AGAINST SUCH INDIVIDUAL AND/OR REFER SUCH MATTERS TO LAW ENFORCEMENT FOR PROSECUTION TO THE FULLEST EXTENT PERMITTED BY LAW.
24. All activity arising out of and relating to the Contest, including any reference to the status of any person as a "winner" is subject to verification and/or auditing for compliance with the Official Rules. If Sponsor determines, in its sole discretion, that verification or auditing activity evidences non-compliance of an entry and/or participant with the Official Rules, Sponsor reserves the right to disqualify such entry and/or participant from the Contest and Prize at any time. Sponsor reserves the right to conduct a background check on any potential winner and to disqualify any individual based on such background check if Sponsor determines in its sole discretion that awarding a Prize to any such individual might reflect negatively on Sponsor. Each participant agrees to cooperate with Sponsor and its representatives in connection with all verification, auditing and/or background check activities.
25. Sponsor reserves the right to correct typographical, printing or clerical errors in any Contest-related materials. No more than the stated number of Prizes will be awarded. If production, technical, seeding, programming or any other reasons cause more than the stated number of Prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of Prizes by a random drawing from among all legitimate, un-awarded, eligible Prize claims.
DISPUTES
26. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant’s or Released Parties in connection with the Contest, shall be governed by Florida law, without giving effect to any choice of law rules that would cause the application of the laws of any jurisdiction other than Florida.
27. Arbitration: Except where prohibited by law, by participating in the Contest, you expressly agree that (a) all disputes and causes of action arising out of or connected with the Contest or the Prize shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association (“AAA”) in accordance with its Commercial Arbitration Rules in Tampa, Florida; and (b) judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
28. By participating in the Contest, you expressly (a) agree that any legal proceedings arising out of or relating in any way to the Contest or these Official Rules shall be brought only in the federal or state courts located in Hillsborough County, Florida, and (b) consent to the mandatory and exclusive jurisdiction in such courts with respect to any such legal proceedings.
29. In the event of any discrepancy or inconsistency between any terms or conditions of these Official Rules and any disclosures or other statements contained in any other Contest-related materials, including but not limited to television, print, mobile or online advertising, the terms and conditions of these Official Rules shall prevail, govern and control. If any provision of these Official Rules is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
