Upon receipt of the completed submission, artists grant North American Hand Papermakers (NAHP) the right to exhibit, reproduce, edit, publicly display, create derivative works of, distribute, post, and otherwise use the entries or any parts thereof, in perpetuity worldwide in any manner for the purposes of promoting the organization without compensation or additional consideration to entrant. 4. By submitting to the Call, the entrants (a) agree to the official rules and the decisions of the judges which shall be final in all respects; (b) consent to the use of the artist's name, likeness, and professional affiliation (if applicable), any statements, quotes or testimonials, photographs, designs, and/or any other audio-visual materials provided by the entrant for advertising, trade and publicity purposes and grants North American Hand Papermakers, Inc., its authorized agents, and designated partners the rights to reprint, display, reproduce, exhibit and sell catalogues and promotional items related to the exhibition without limitation and without any compensation except where prohibited by law; (c) release North American Hand Papermakers, Inc., its subsidiaries, sponsors, partners, and affiliates and their directors, officers, employees and agents from any and all liability for any losses or damages of any kind caused by participation in the contest; (d) agree that entries shall not contain unauthorized trademarks, copyrighted or confidential material, or any other inappropriate materials as determined by North American Hand Papermakers. 5. NAHP is not obligated to display any entry. 6. Jurors and their immediate family are not eligible to enter the Call. Individuals are eligible to enter only if they are the original creator of the submitted works and the works were created within the last two years. 7. By receipt of any prize, winner agrees to release and hold harmless Released Parties from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the contest or receipt or use or misuse of any prize. 8. Disputes: Except where prohibited, entrants agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Call shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the appropriate State Court of the organization's leadership. (b)any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Call, but in no event attorneys' fees; and (c) under no circumstance will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and NAHP in connection with the Call, shall be governed by, and construed in accordance with, the laws of the State of the organization's leadership without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the that of leadership of NAHP.
