Thank you for allowing Macon Arts Alliance to exhibit your work in our June 2021 Exhibition. By signing this contract, you agree to meet the delivery dates and the following terms: 1.Your exhibit will run from June 4, 2021 thru June 25, 2021 . Macon Arts will host an opening reception for the exhibition on June 4, 2021, 4-7pm. 2.Please deliver your work to the gallery between May 25th - 29th, 2021 (10am - 5pm). Please Note: All 2-D work must be wired for hanging. 3.Artwork must remain at Macon Arts Alliance through June 25th, 2021. Works sold during the show will remain on display until the end of the show. Unsold work can be picked up after June 25th. Works being shipped back to the artist must be arranged beforehand and the artist must pay for any postage. 4.Macon Arts Alliance will receive 40% of each sale. Artists will receive 60% of each sale. Checks are mailed out mid-month following the month of the sale to the artist address on file. Commissions due less than $25 are paid in June and December. (Checks mailed in July and January). Unless mutually agreed upon, any discounts offered from Macon Arts Alliance are taken out of our commission. 5.Macon Arts Alliance reserves the right to rotate work on display at our discretion.6.Loss, damage, and theft of items are dealt with on a case-by-case basis, and compensation for such items will be at the discretion of Macon Arts Alliance and the artist. A customer or patron who has broken or damaged a piece will be asked to pay for the item. An agreement that is both acceptable to Macon Arts Alliance and artist will be met in these regards. 7.Art consigned to the Macon Arts Alliance can only be purchased through the Macon Arts Alliance Gallery. Any patron contacting the artist in regard to purchasing a piece at the Gallery should be directed to purchase the piece from Macon Arts Alliance. We rely on the artist’s support of this honor system. 8.Macon Arts Alliance may list your work for sale in our online Gallery at www.maconarts.org/shop. This agreement includes work sold through this platform. Work for sale online must be physically present at the Gallery. 9.Macon Arts Alliance maintains the right to claim ownership of an item left 365 days after an arranged pick-up date. 10.If a customer puts a piece on layaway, the item is to be held by Macon Arts Alliance until either the piece is paid for or the buyer forfeits his/her claim on the piece. The terms under which Macon Arts Alliance will put a piece on layaway will be agreed upon by the buyer and the Macon Arts Alliance staff. 11.Work may be removed from the Gallery for off-site display purposes, or ‘on approval’ with captured purchasing information. Otherwise, customers are not allowed to take any item out of the Gallery until it is completely paid for. The Artist agrees that digital images captured during the Exhibition, including those of the Artist’s personal work or property, may be used and reproduced by Macon Arts Alliance, in its sole discretion, at any time, for promotional, educational, documentation or non-commercial purposes without any prior approval by Artist or consideration due Artist. Macon Arts Alliance shall retain the right to so use and reproduce these digital images following the expiration or termination of this Agreement. Force Majeure: In the instance that Macon Arts Alliance is unable to uphold this agreement due to circumstances beyond the reasonable control of Macon Arts Alliance, this agreement is null and void. Further, Macon Arts Alliance shall not be liable for any failure of or delay in the performance of this agreement in such an instance. The undersigned Artist irrevocably and unconditionally agrees, to the fullest extent permitted by law, to defend, indemnify, and hold harmless Macon Arts Alliance, its officers, directors, trustees, employees, and agents, from and against any and all claims, liabilities, losses, and expenses in any way arising from or in connection with any act or omission of the artist or artist’s agents that may occur in the course of the event, except and unless such claims, liabilities, losses, or expenses arise from or in connection with any act or omission of Macon Acts, its officers, directors, trustees, employees, or agents.
