Submission Terms; Regardless of application status, any fees paid through CAFE are non-refundable by Dab Art Co. (i.e. submissions, applications and consultations). Exhibition Invitation Terms; By finalizing CAFE legal agreement, Artist agrees to all terms and stipulations listed. 1. Artist retains ownership of all artwork on loan to Dab Art Co. Artwork must be original, unsold work. The Artist must be the sole copyright owner. Artist will retain copyrights to artwork in perpetuity, as governed by law. Any and all images provided by artist to Dab Art Co. can be used for promotional purposes (online or in print) pertaining to inventory, sales and events. 2. List price for each artwork on loan will be established by Dab Art Co. in consultation with Artist. Factors influencing the list price include history of prior sales, market demand, and curator’s knowledge of gallery inventory, collector requests and original artwork submissions. Dab Art Co. has the right to list and negotiate up to 20% of the list price on all artwork loaned. Artist will be consulted on offers made below the 20% threshold prior to the sale of artwork on loan. 3. Dab Art Co. will exert all reasonable efforts to close sales of loaned artwork. Artist agrees to provide Dab Art Co. upon request, with any necessary documents or information in support of sales in a timely fashion. 4. Dab Art Co. retains a 50% commission on the final sale price of all unique and/or editioned artwork sold during any exhibition (online or in gallery) and up to 30 days after the close of the exhibition for purposes of sales pending (when applicable). 5. Sales remittance to Artist will be provided within 60 days after the close of exhibition and receipt of payment from Buyer to Dab Art Co. has been finalized. Dab Art Co. will provide Artist with a remittance statement for any and all sales. All online sales will be remitted from the Dab Art Co. headquarters in Los Angeles, California. Artists are responsible for income taxes associated with the sale of their artwork. Artists whose remittances exceed the federal taxable income threshold of $600 will be asked to fill out a W9 and will provided with a 1099 taxable income form by January 31st, 2022. 6. Dab Art Co. is not responsible for faulty hangers or mounts on framed or unframed works. Frames, mats and wiring must be professional quality and in good condition. Wires must be securely fashioned and support weights of the artwork. 2d artwork selected for exhibition must be ready to hang. 3D artwork and freestanding sculptures must be able to stand or hang securely and independently. Framed or unframed artwork, improperly or poorly mounted artwork, panels or canvases without a secured wire hanger is not be covered by our limited liability insurance. Dab Art Co. is not responsible for artwork damage caused by natural disasters (i.e. earthquakes). 7. All shipped artwork must include a return label from Artist’s preferred courier (e.g. FedEx, UPS, DHL, etc.). Parcel packaging must be suitable to re-use for return shipping. Absolutely no packing peanuts! Crates, boxes, even small packages containing packing peanuts will be resealed and shipped back to Artists, no exceptions. Artwork sent through the US Postal Service, must include a prepaid shipping label, USPS stamps will not be accepted. 8. Artist is responsible for round-trip shipping and handling costs, packaging and transport insurance of artworks. Dab Art Co. is not responsible for artwork damaged or lost during shipping. Damage to artwork may not be noticeable upon arrival; the gallery will be diligent in documenting any and all damage caused in transport (whether upon arrival or when artwork is unpacked). Dab Art Co. will notify the Artist as soon as possible if damage during transport has occurred. 9. Dab Art Co. reserves the right to refuse artwork(s) that are not professionally presented, securely mounted and/or that do not resemble original online submissions. In the event that an Artist’s artwork(s) are refused upon arrival to the gallery, the Artist is not entitled to reimbursement(s). Any costs and/or fees associated with the exhibition are non-refundable (i.e. submissions, applications, artwork preparation and/or packaging, shipping and handling, exhibition preparation, etc.) 10. Artist agrees that artwork on loan to Dab Art Co. during the term of this agreement (originals and/or prints and duplicates) will not be displayed, exhibited or shown in other galleries or platforms (online or physically) while artwork is on loan to Dab Art Co. Artwork received and accepted into the gallery will remain onsite for the term of this agreement and up to 30 days after the close of the exhibition for purposes of sales pending (when applicable). 11. Artwork unsold at the end of the exhibition and/or term agreement must be retrieved in a timely manner. Artwork must either be picked up in person or shipped back to Artist (return label provided by Artist). If artwork on loan to Dab Art Co. is not retrieved within 45 after the close of exhibition and/or term agreement will be considered forfeited by Artist (unless other arrangements have been discussed). Forfeited artwork becomes the property of the Dab Art Co. 12. All artwork listed for sale during an online exclusive exhibition and/or online inventory with Dab Art Co. must be packed and ready to ship in preparation for sale. It is the responsibility of the participating artist to pack artwork in a box or create appropriate for shipping. Dab Art Co. is not responsible for any damages to artwork caused during shipping. The artist must provide Dab Art Co. staff with accurate package dimensions (height, length, width and weight) upon request. Artwork package dimensions determine shipping quotes and costs for buyers. Artists will be financially liable for increased/additional shipping costs as a direct result of inaccurate package dimensions. Additional shipping costs accrued as a result of inaccurate package dimensions will be deducted from final sales remittance. 13. Print reproductions of unique or editioned artwork may be produced by Dab Art Co. for the purpose of exhibition in leu of original artwork. Dab Art Co. will notify artists if such reproductions are applicable to the exhibition. Reproduction prints will not be listed for on sale on our Artsy Platform.
