ENTRY FEES (Non-refundable application fees): First three images for $30; each additional image is $5 per image. A maximum of six images may be submitted for consideration. This Agreement (the "Agreement") is at this moment entered by and between FE GALLERY and the undersigned ("ARTIST"). In exchange for the presentation of my artwork in a gallery, I at this moment agree to the following: 1. The Art in this application will be available for showing at Fe Gallery during the following showtime, including drop-off by August 28, 2021 (show opens September 11, 2021 and runs through October 22. Furthermore, the Artist agrees that he/she will not show the artwork consigned with Fe Gallery 6 months prior at any other local venue (without Fe Gallery's permission) before his/her show with Fe Gallery 2. If local, the Artist will participate in 'Sacramento's 2nd Saturday Opening Artist Reception' at Fe Gallery during the first month of the consignment from 5:45 pm until 9:00 pm. Closing Reception, second month on 4th Friday, is optional. 3. The Artist shall furnish to Fe Gallery information necessary to provide a complete gallery presence. This information includes the Artist's statement, a signed copy of this contract, a name (title), and a description of each piece to be shown along with the item's price and size and media-ready photos of his/her Art for publicity and online sale. 4. The signed consignment agreement is due immediately. Artists may drop off their completed Art List at a later time. Art List must be received by the Art drop-off day (attach a copy of the contract if you choose to do this). 5. All artwork is selected for consignment by the Fe Gallery team to complement the Gallery. 6. Before new pieces are consigned, Fe Gallery requires an up-to-date artist statement on file and all the proper paperwork to be filled out and dated. All photographs submitted to or commissioned by Fe Gallery and any photos taken while Fe Gallery consigned will become the Fe Gallery's property. Fe Gallery reserves the right to use any artwork or imagery (during and after consignment) of artwork for Fe Gallery's promotional and business activities. PROMOTION: All entrants grant Fe Gallery the right to use or publish images of their work to promote the art exhibits, future calls for entries, videos, the Art, and Fe Gallery. Selected entries may be included on our Website, Facebook Page, Twitter, or other social media sites to promote artists and shows. I understand that my artwork may be photographed for promotional or other purposes. 7. ARTIST retains ownership of all "ARTWORK" represented by Fe Gallery until such "ARTWORK" is sold under the terms of this Agreement or otherwise. ARTIST retains copyright to all consigned artwork in perpetuity. 8. Each guest Artist shall drop off or ship his/her art 'Show Ready' - properly tagged with Title/Artist Name, clean, in good condition, ready for display (if Art is to be mounted, it must be prepared to be hung). If the Art is not 'Show Ready, Fe Gallery may choose not to show it. Fe Gallery reserves the right to select which Art will be displayed and makes no guarantees that all Art will be shown during consignment. 9. By submitting work for exhibition, the Exhibitor authorizes Fe Gallery to sell such work for the "Sale Price" indicated for each piece on Art List (if the list is submitted separated the same terms apply). After a sale occurs, Fe Gallery will reimburse the Exhibitor an amount equal to the "Sale Price" less 40% commission. Artist shall list sale price on Art List; this includes the gallery commission. *International artists are responsible for any exchange rate charges. 10. All unsold artwork must be retrieved from Fe Gallery the day after consignment ends unless other arrangements have been made. Any artwork left at Fe Gallery 15 days after the exhibition's close will be subject to a $5.00 per day. Any artwork left at Fe Gallery for more than one month is subject to sale or disposal without notification. 11. Shipping and Delivery Cost is the sole responsibility of the Artist. Each Artist is to make arrangements for packaging and delivery before his/her Art being exhibited. Additional Conditions of Delivery: A) Shipped work disqualified from the exhibition will be returned at the Artist's expense. B) Artwork that is being shipped to the Gallery must be received by August 28, 2021. Any accepted works that are not received by August 28, 2021, art will not be exhibited. Shipping containers will be stored and reused for the return shipment. C) The Artist will be notified if the Art arrives damaged. Artwork must be received ready to display. D) Shipping containers using packing materials that cannot be reused will be returned to the Artist at the Artist's expense. E) Fe Gallery is not responsible for any damage, breakage, replacement, or cost associated with any damage or breakage that may have occurred during transport or unpacking. Fe Gallery assumes no liability for any loss or damage to any artist's work while in our care, custody, or control, before, during, or after the exhibition. F) If you would like your Art to be professionally packed and shipped back to you, please make arrangements with the shipper and Fe Gallery before sending your Art to Fe Gallery. 12. The Artist appoints the Gallery as their agent to sell the consigned works in the attached schedule of works. During consignment with Fe Gallery, the Artist will not sell the same item(s) on his/her website, or any other website, or anywhere else, until after consignment ends. This Agreement does not make the Gallery an exclusive agent for any other works in any other venue. Any art shown at the Gallery for sale online will NOT be sold at a lower price online than it shall be sold Fe Gallery for six months before & after showing at Fe Gallery. 13. The Artist understands that while under consignment with Fe Gallery, his/her Art may also be sold on Fe Gallery's online store under the same terms, 40% commission to Fe Gallery and 60% commission to the Artist the Sale Price listed on this contract. 14. Security --- Fe Gallery provided a locked and alarmed building where art pieces will be exhibited and stored. 15. Liability --- Fe Gallery cannot assume any responsibility for damage incurred before, during, or after the exhibit. ARTIST will maintain insurance for fire/vandalism and affirms that all "ARTWORK" will be covered by said insurance while in Fe Gallery's possession. In no event shall Fe Gallery be liable for any injury, loss, damage, theft, or disappearance of or to property. Fe Gallery will make all reasonable efforts to protect artwork from accidental damage or breakage. Fe Gallery does not provide insurance liability for accidental damage or breakage. 16. Fe Gallery does not guarantee the sale of any items exhibited. 17. Artist guarantees that all art pieces are his/her original artwork. The applicant certifies that the applicant's information, including all supporting documents and attachments, is true and correct to the best of his or her knowledge. Any fraudulent statement made in the application will be grounds for rejecting the application. The program reviewers and jurors, at their discretion, may eliminate candidates that are considered not to meet entry criteria. By applying for this call, ARTIST agrees to each stipulation as outlined in this Agreement.
