By submitting your art data in this "Opportunity", you as "Artist", are bound by the following terms:

Note: "Gallery" or "Galleries" refers to a third-party or partner online gallery or shop.

Submission

- Artist is free to submit any collection of her/his artworks. However, offered artworks are subject to approval.

In reasonable view of the organizer, artworks that include porn, violence, and/or racial and religious hatred, inappropriate and/or offensive content are not admissible.

Duration

- The duration of this Opportunity is 3 months from the selection announcement date. 

Information

- Artist is responsible for providing all the necessary information for this Opportunity.

- All provided information by Artist should be genuine and accurate.

- Artist should immediately inform Biafarin of any changes in her/his artistic data.

- By participating in this Opportunity, Artist will give Biafarin the right to use its data and artworks' images for promotional and publishing purposes.

Language

- All information and communications will be in English.

- In case of any discrepancies, the English language will be considered as the source.

Artwork Availability

- All artworks or their prints must be presented for sale.

- All artworks must be available for sale from the time of submission.

- In case of any availability problem after selection, it is the Artist's sole responsibility to inform Biafarin that the artwork is not available for sale anymore.

Artwork Originality

- All artworks provided by the Artist should be original and created by the Artist without any supervision.

Pricing

- Artist is responsible for setting a price for each artwork.

- Galleries usually have a set price for prints and merchandise of artworks presented on their platforms. In the case of selling artworks prints or image placement on other products, if the Artist sets no price, the Gallery's set price will be considered.

Selection

- All submitted artworks will be reviewed and selected according to the overall criteria mentioned in the artwork eligibility section of this Opportunity.

Announcement

- Artists will be notified if their artwork has been selected for this Opportunity.

Artwork Distribution

- All selected artworks will be presented in up to 100 online placements in various shops according to their preferences.

- Each selected artwork will be added to the Galleries matched by Biafarin.

Shipment

- When an original artwork is sold, it is needed to be shipped to the buyer.

- Artwork shipment is the Artist's responsibility.

- In case of any sales of original artworks, shipment costs for Gold and Platinum packages will be covered by Biafarin, if approved.

Commissions

- In case of any sales, Biafarin commission is zero percent.

- In case of any sales, Gallery's related rules for sales commission will apply.

- Each online Gallery charges a commission in case of sales. The percentage is usually between 5% to 20%. 

Sales Money Transfer

The Artist will either provide a Paypal account for transferring the sales amount to her/his account (if possible) or accepts Biafarin to assign a Paypal account to collect sales payments on her/his behalf.

- Collected sales payments by Biafarin will be transferred to the Artist's account every month.

Sales Options

- Selling original artworks, artwork prints, and artwork photos digital files on merchandise is possible.

- Sales options are available upon Artist's approval.

- Most of the Galleries offer to sell print and merchandise. In this case, usually, the related costs will be deducted from Artist's sales share.

Fees

- Selection fees will be applied to selected artists.

- All fees are non-refundable.

Communication

- All communication will be handled via Biafarin platform and the Artist's email account, which is presented at the time of submission.

- To avoid any confusion, Artist accepts and guarantees not to contact any of the Galleries and other service providers in this Opportunity directly or indirectly without Biafarin written consent.

- Artist should immediately inform Biafarin of any changes in her/his position or situation.

Exclusivity

- This Opportunity is not exclusive. Each Artist can continue to use other Biafarin services or work with third-party entities.

- Artist's participation in this Opportunity won't prevent her/him from using Biafarin or any other third-party services.

- Artist will be informed of any exclusivity term from Galleries.

Continuity

- Biafarin team will do their best to run this Opportunity. Still, neither guarantee any level of exposure or sales via this Opportunity nor are they responsible for paying any damages claimed by artists or third parties.

- This art Opportunity is provided to Artist 'as is' and 'as available' without any representation, warranties, or conditions of any kind.

Termination

- Artist can stop her/his participation in this Opportunity with a 2-week prior written notice.

- In case of no communication from the Artist's side for more than one month, Biafarin can stop the Opportunity without further notice to the Artist.

- Artist's request to terminate her/his participation won't affect the completion of all running activities in this Opportunity.

Discrepancies

- Artist is solely responsible for all the discrepancies that happen due to a complaint from a third party concerning this Opportunity.

Indemnification

Artist agrees to indemnify, defend and hold harmless Biafarin and its employees and directors harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Artist's breach of these Terms or Artist's violation of any law or the rights of a third-party.

Other

- All Biafarin Terms of Service and Privacy Policy will apply to this Opportunity.
