ENTRY FEES (Non-refundable application fees).
This Agreement (the "Agreement") is at this moment entered by and between FE GALLERY and the undersigned ("ARTIST"). In exchange for the presentation of my artwork in a gallery, I at this moment agree to the following:
1. If local, the Artist will participate in 'Sacramento's 2nd Saturday Opening Artist Reception' at Fe Gallery during the first month of the consignment from 5:45 pm until 9:00 pm.
2. The Artist shall furnish to Fe Gallery the information necessary to provide a complete gallery presence. This information includes the Artist's statement, website or other social media information, a signed copy of this contract, a name (title) and or a description of each piece to be shown along with the price and size of the item and a minimum of one media-ready image of each piece of their art for publicity. (Once accepted, you are bound by the Agreement but will receive a Fe Gallery contract to be signed and returned.)
3. Acceptance at the image judging stage does not necessarily guarantee inclusion in the exhibition.
4. Should any piece of art differ significantly from the original image entry (including price), the art will be disqualified, and the art will not be exhibited.
5. Any piece that is inappropriately presented will be disqualified.
6. Signed consignment agreement is due immediately upon receipt.
7. Before new pieces are consigned, Fe Gallery requires an up-to-date artist statement on file and all the proper paperwork to be filled out and dated. All photographs submitted to or commissioned by Fe Gallery and any photos taken while consigned by Fe Gallery will become the property of Fe Gallery. Fe Gallery reserves the right to use any artwork or imagery (during and after consignment) of artwork for promotional and business activities of Fe Gallery. PROMOTION: All entrants grant Fe Gallery the right to use or publish images of their work to promote the art exhibits, future calls for entries, videos, the Art, and Fe Gallery. Selected entries may be included on our Website, Instagram, Facebook Page, Twitter, other social media sites, and other publications to promote artists and shows. I understand that my artwork may be photographed for promotional or other purposes.
8. ARTIST retains ownership of all "ARTWORK" represented by Fe Gallery until such "ARTWORK" is sold under the terms of this Agreement or otherwise. ARTIST retains copyright to all consigned artwork in perpetuity.
9. Each guest Artist shall drop off or ship their art 'Show Ready' - properly tagged with Title/Artist Name, clean, in good condition, ready for display (if art is to be mounted, it must be ready to be hung). At the time of drop off, if the art is not 'Show Ready,' Fe Gallery may choose not to show it. Fe Gallery reserves the right to select which art will be displayed and makes no guarantees that all art will be shown during consignment.
10. By submitting work for exhibition, the Exhibitor authorizes Fe Gallery to sell such work for the "Sale Price" indicated for each work on Art List (if the list is submitted separately, the same terms apply). After a sale occurs, Fe Gallery will reimburse the Exhibitor an amount equal to the "Sale Price" less 40% commission. Artists shall list sale price on Art List; this includes the gallery commission. *International artists are responsible for any exchange rate charges. *Artwork selected through CAFÉ call to entry site may not change the sale price without Fe Gallery's permission.
11. Unless other arrangements have been made, all unsold art must be retrieved from Fe Gallery within a week after the consignment ends. Any work left at Fe Gallery 15 days after the exhibition's close will be subject to $5.00 per day. Any work left at Fe Gallery for more than one month is subject to sale or disposal without notification.
12. Art for "VERDANT HEART" must be at Fe Gallery by April 1, 2022, or it will not be shown.
13. SHIPPING (READ CAREFULLY) Shipping and Delivery Cost is the sole responsibility of the Artist. Please No packing peanuts. Crates, boxes, even small packages containing packing peanuts MAY be resealed & immediately shipped back to you. Artists are responsible for round-trip shipping & insurance (during shipping) of artworks.

B. Shipped work disqualified from the exhibition will be returned at the Artist's expense.
C. Artwork that is being shipped to the Gallery must be received by APRIL 1, 2022. Any accepted works that are not received by APRIL 1,2022 will not be exhibited.
D. Shipping containers will be stored and reused for the return shipment.
E. You may include a return label or email us a return label at the end of the exhibit if it is not sold. *Hint, keep a copy of your shipping label; you will need the packaged box's weight and dimensions to purchase the label.
F. If you choose to have it professionally packed by UPS or Fed Ex, the Gallery will take the art and your packing materials to them for packing at your expense
G. Shipping containers using packing materials that cannot be reused will be returned to the Artist at the Artist's expense.
H. Fe Gallery is not responsible for any damage, breakage, replacement, or cost associated with any damage or breakage that may have occurred during transport or unpacking. Fe Gallery assumes no liability for any loss or damage to any artist's work while in our care, custody, or control before, during, or after the exhibition.
14. The Artist appoints the Gallery as their agent to sell the consigned works in the attached schedule of works. During consignment with Fe Gallery, the Artist will not sell the exact item(s) on their website, any other website, or anywhere else until after the consignment ends. This Agreement does not make the Gallery an exclusive agent for any other works in any other venues. Also, any art shown at the Gallery for sale online will NOT be sold at a lower price online than it shall be sold Fe Gallery for six months before & after showing at Fe Gallery.
15. Furthermore, the Artist agrees that they will not show the artwork consigned with Fe Gallery 6 months prior at any other local venue (without Fe Gallery's permission) before their show with Fe Gallery
16. Security --- Fe Gallery does provide a locked and alarmed Building in which Art pieces will be exhibited and stored.
17. Fe Gallery will exercise every possible precaution in handling all works of art, but it cannot assume any responsibility for damage incurred before, during, or after the exhibit. ARTIST will maintain insurance for fire/vandalism and affirms that all "ARTWORK" will be covered by said insurance while in Fe Gallery's possession. In no event shall Fe Gallery be liable for any injury, loss, damage, theft, or disappearance of or to property. Fe Gallery will make all reasonable efforts to protect artwork from accidental damage or breakage. Fe Gallery does not provide liability insurance for accidental damage or breakage.
18. Fe Gallery does not guarantee the sale of any items exhibited.
19. Artist guarantees that all art pieces are their original artwork. If any Digital paintings, photography, Giclee prints, or anything that can be reproduced, it MUST be hand-signed (either front or back). The artists must certify that it is a limited print (including the number and how many may be printed in the future).
The applicant certifies that the information contained in the application, including all supporting documents and attachments, is true and correct to the best of their knowledge. Any fraudulent statement made in the application will be grounds for rejecting the application.
The program reviewers and jurors, at their discretion, may eliminate candidates that are considered not to meet entry criteria.
By applying for this call, ARTIST agrees to each stipulation as outlined in this Agreement.
