1. The Artist agrees to exhibit at the Presenter’s “Dune Birds in Art” exhibit at the Indiana Dune Visitor Center located at 1215 N SR49, Chesterton, IN 46304 from May 11th to June 4th 2022. The Artist agrees to this contract via submitting entry to Cafe online.

2. The Artist agrees to handle all individual art sales during the exhibit to “Dune Birds in Art.” Presenter is not responsible for artist sales and does not take a commission fee for the exhibit. A price list with artist's contact information will be available at the front desk of the Visitor Center for any sales inquires (Artists are encouraged to leave business cards at drop off for this purpose). 

3. The terms and conditions set forth in this Agreement shall have precedence over any attachment incorporated herein in the event of any conflict. 

4. In the event that either the Presenter or the Artist is unable to fulfill its obligation due to damage or destruction of the venue by fire, verified disability of the Artist, acts or regulations of public authorities, labor difficulties, civil tumult, strike, epidemic, or any unforeseen occurrence rendering the exhibit(s) impossible, neither the Artist nor the Presenter shall be held legally responsible for any damages arising from the cancellation of the exhibit(s) listed herein. Cancellations or changes of date for reasons other than those listed above shall render the Artist liable for any expenses, documented in writing, incurred by the Presenter in connection with this event. 

5. With respect to insurance, the Artist is responsible for his or her liabilities. Please note that the exhibition facilities are well-staffed and include security cameras both inside and outside the building. 

6. This agreement, including any addenda thereto, cannot be assigned or transferred without the mutual written consent of both the Artist and the Presenter and contains the complete understanding of the parties respecting the subject matter hereof. It is expressly understood and agreed that the Presenter makes no representations or agreements, oral or otherwise, outside the terms of this Agreement which add to, broaden, vary, or conflict with the provisions hereof. Any purported outside representations or agreements have no force or effect upon the rights or duties of the Presenter hereunder. No term, provision, or condition of this agreement may be altered, amended, or added except upon the execution of a written agreement by the parties hereto. Any notices provided for herein shall be in writing and shall be personally served or mailed to the Artist at the addresses provided. 

7. The Presenter agrees to provide promotional postcards for the exhibition. Postcards will be handed out to Artists during artwork drop off dates. 

8. The Artist agrees to communicate to the Presenter’s delegate at dunebirdsinart@gmail.com or ATTN: Dune Birds In Art |  410 E Oak Hill Rd | Porter, IN 46304 or drop off with artwork by 2pm on Monday May 9th 2022. It is understood that the Presenter retains the right to solely determine the copy and content of its program. 

9. The Presenter agrees to market the “Dune Birds in Art 2022” art exhibit in various radio, print, television, internet, email, and social media sites and reserves the right to use the Artist’s name, artist’s statement with website link, and photos of art pieces in such marketing.

10. In regards to any 3D or sculptural work, the presenter will provide the display pedestal for the exhibit.. 

11. The Artist will deliver artwork to the Presenter on Sunday, May 8th from 10am – 2pm or Monday, May 9th 2022 from 10am-2pm CT at the Indiana Dunes Visitor Center located at 1215 N SR49, Chesterton, IN 46304.  Any alternate drop off dates must be discussed with presenter's delegate. 

12. The Artist agrees to allow Presenter to hang His/Her own artwork on the panels, easels, or pedestals. The Artist is welcome to schedule a time to assist the Presenter with installation of the exhibit. 

13. The Presenter agrees to have all set-up finished no later than 3pm on Tuesday, May 10th 2022. 

14. The Artist agrees to be responsible for the pick-up of His/Her artwork on Sunday, Sept June 5th from 10am-2pm or Monday, June 6th 2022 from 10am-2pm CT. Presenter is not responsible for any artwork not picked up after July 2022.
